A Woodbridge man wanted for involuntary manslaughter in a fatal Aug. 28 crash in Nokesville has been arrested.
On Dec. 11, investigators obtained warrants for James Francis Byrd, 62, of the 1400 block of Maryland Avenue in Woodbridge, for DUI-related involuntary manslaughter, Prince William County police Master Officer Renee Carr said in a release. He was arrested on the charges Wednesday.
Officers responded to the two-vehicle crash on Bristow Road in the area of Windy Hill Drive at 6:24 p.m. that night. Police said the driver of a 2021 Toyota Tundra was traveling eastbound on Bristow Road when the vehicle crossed over the center line into the westbound lane, striking a 2003 Lexus GX head on.
The impact of the crash caused the Lexus to spin off the roadway and come to a rest in the ditch while the Tundra remained on the roadway, Prince William County police Officer Joshua Spiler said in a news release.
The driver and sole occupant of the Lexus, 63-year-old Thomas Spencer Stark, was taken to an area hospital where he died, Spiler said.
It was later determined Byrd, the driver of the Tundra, had a blood alcohol content level above the legal limit on the day of the crash, Carr said.

...why was he not arrested at the scene of the accident?
He very well may have been arrested then, but they can't hold him without charges. They didn't have a warrant to charge him until December 11th.
You mean detained. If he was arrested, he would've been charged, and his arrest record shows that he was not arrested for DUI after the crash. I can't believe they weren't even suspicious of drunk driving.
